Terms of Service
Last updated 4 November 2026
Acceptance
These terms are the agreement between you and the operator of Braineey ("we", "us") when you play Braineey or use this website. By playing or creating an account, you agree to them. If you do not agree, please do not use the game.
How we handle your data is in the Privacy Policy.
Using the game
Braineey is a quiz game: the same Daily 10 for everyone each day, Sudden Death, practice of past games, duels, live games with friends and live shows. Playing is free. Lives, which let you carry on a Sudden Death run, can be bought.
We give you a licence to play for your own enjoyment. It is personal to you, you cannot pass it on, and we can end it under these terms. You may not:
- copy, scrape or republish the question bank, or collect questions with a program (sharing your own result is fine);
- copy, reverse engineer or take apart the game, or try to reach parts of it not meant for players;
- use the game, its questions or its name for a business without our written permission;
- overload, attack or interfere with the game, or get around its bot check or its limits.
We may add, change, pause or remove features at any time.
Accounts
- You can play without an account. Your game is then kept in this browser: if the browser loses its cookie, the game is lost to you. Signing in keeps your game on every device, and you need an account to buy lives.
- If you are under 18, you need a parent's or guardian's consent to create an account and to buy lives. The parent or guardian who consents is responsible for how the child uses the game.
- One account per person. The details you give us must be true.
- Keep your sign-in to yourself; you are responsible for what is done with it. If you think someone else has used your account, tell us.
Conduct and fair play
- No bots, scripts or tools that answer for you.
- No sharing the answers to a game, such as today's Daily 10 or a live show, while others can still play it.
- No extra accounts to climb a leaderboard, win a duel or collect free lives.
- No nicknames or feedback that insult, threaten or harass anyone, or pretend to be someone else.
- Nothing that breaks the law.
We look for cheating, as the Privacy Policy explains. If you break these rules, we may remove your scores, change your nickname, and suspend or close your account.
Questions and scores
We check every question, but mistakes happen. If you find one, tell us with Send feedback on Me. When we correct a question, we may change the scores, places and streaks that depended on it.
Leaderboards show your nickname and your scores to other players.
Lives and payments
- Lives let you carry on a Sudden Death run after a wrong answer. They are sold in packs and paid for with M-Pesa. We may also give lives free, for example when you create an account.
- Prices are in Kenya shillings and shown before you pay. You confirm the payment with your M-Pesa PIN on your phone. Safaricom's own terms apply to M-Pesa.
- Your lives are added once M-Pesa confirms the payment. If the confirmation is late, they are added when it arrives. If M-Pesa took your money and the lives did not arrive, tell us: we add the lives or return the payment through M-Pesa.
- Lives are a licence to play, not money. They have no cash value, cannot be exchanged for money, and cannot be transferred, sold or moved to another account.
- Once your lives are added, a purchase cannot be refunded, except where Kenyan law, including the Consumer Protection Act, 2012, gives you a right to a refund.
- Lives belong to your account. Deleting your data deletes any lives you have left, and so does closing your account for breaking these terms. They are not refunded.
- We may change packs and prices. A change never affects a purchase already made. We may limit how many purchases you can start in an hour.
- Playing never pays you money, and the game offers no cash prizes today. If we offer a prize, its rules are published with it, and we may hold a prize while we check that it was won fairly.
Disclaimer
We work to keep the game running and the questions right, but we provide it as it is and as available. We do not promise that it will always be available, free of errors or right for any purpose. The game is for fun: do not rely on its questions or answers as advice. We are not responsible for services we do not run, such as M-Pesa, Google, Facebook or your mobile network.
Limitation of liability
As far as the law allows, we are not liable for loss we could not have foreseen, or for lost profit, time or opportunity. Our total liability to you for any claim is limited to what you paid us in the 12 months before the claim.
Nothing in these terms limits a liability that the law does not allow to be limited, such as for fraud, or takes away your rights as a consumer under Kenyan law.
Intellectual property
The game, its questions, its design, its name and its logo belong to us or to those who license them to us. These terms give you no right to use them beyond playing. Sponsors' names and logos belong to the sponsors.
You choose your nickname, and by playing you let us show it with your scores. If you send us feedback or suggest a question, we may use it to improve the game without paying you.
Termination
You can stop playing at any time and delete your data, as set out in Deleting your data.
We may suspend or close an account, or block an address, that breaks these terms or puts other players or the game at risk. Where we can, we tell you why. We may also stop offering the game; if we do, we tell players in the app first.
Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya decide any dispute about them. Before going to court, please contact us so we can try to settle it.
Changes
When these terms change we update this page and the date at the top. If a change matters to you, we tell signed-in players in the app before it applies. If you keep playing after it applies, you accept the new terms.
